Germany: New Provisions for Consumer Contracts

Starting March 1st, 2022, Germany requires the following for any consumer contracts:

  • A renewal will only be effective if concluded for an indefinite period of time

  • The contract may be terminated by the consumer after the extension at any time with a notice period of one month

Starting July 1, 2022, Germany will require a clearly visible withdrawal button (or similar) must therefore be placed on the website via which online contracts are concluded.

Zingfit is compliant with these provisions. It is the studio's responsibility to configure contracts accordingly.

How to comply to these provisions:

  • Select 'Yes' for 'Customer can cancel':

  • Use the 'Series Terms' to communicate the renewal expectation on your contract. This is a text that the customer must agree to and acknowledge prior to purchasing when online. Please note, when selling the membership in studio, the customer does not see these terms.

Any changes to the zingfit contract build will not be retroactive. In order to comply with these provisions, the studio will need to re-sell the contract with the updated settings.

When a customer cancels their contract

The customer needs to log into their account online and view their series. From there they can choose to cancel the contract. Once they select this, the contract will end immediately; they will not receive any refund.
